I had a minor accident with my car. This young man backed up hitting the back of my car. There was $369.15 worth of damage. I called the police right then and filed a police report.

The car that my car was hit by belongs to his grandmother.
He said he has insurance and I guess he does because the police asked to see our insurance card. I called my insurance company and he called his insurance company the next day.

His insurance company called the grandmother and the boy and they haven't returned their calls. I am thinking that I am going to get screwed over.

My insurance company told me if I don't here from their insurance company in a week, I should call a magistrate. I don't think that is right. Why should I go through a magistrate. I may be wrong, but I think my insurance company should get a hold of their insurance company and straighten this out. Or my insurance company should send me a check and then get reimbursed by Safe Auto.

This morning, I called Safe Auto and left a message and hopefully they will call me on Monday. I guess if they don't call me on Monday, I guess I will have to go to a magistrate which I think is a bunch of crock.

Any advice?

Thank you

You said - "I think my insurance company should get a hold of their insurance company and straighten this out" The problem is, that's not your insurance company's job. Their job is to pay you (or the other party if it's your fault). Did you file a claim with your insurance company?

You said - "Or my insurance company should send me a check and then get reimbursed by Safe Auto" Yes, they could do that if you file a claim with your company. The problem is that if the other company decides not to pay for any reason, the money will end up coming from your company and your rates will go up. Probably not worth it for $370.

Ask your insurance agent how to handle this. Tell them you don't want to file a claim because you were not at fault, but you want to file a claim against the other party. They will give you a basic procedure to follow. Essentially, you call the other company and file the claim. They'll ask you all the details of the accident. They'll then arrange for an estimate of the damage on your car and talk to the other guy. After all the information is in, they'll either pay you or not. If not, you can ask your company to help you, but you may have to file a claim to do that (bad - see above).

Hopefully the other company will just pay you to go away.

If grandma had insurance on her car, and the kid was old enough to drive and had licence, and she let him have the car then her insurance will pay for the damage. Most times you will need a police report, a damage estemate, then turn that into your insurance co. If it was in fact the kids fault, your insurance co will have your car fixed, then they sue the other comany for reinbursment. If its a small claim like you posted, they may just pay and not bother with the other company. The bigger the claim the bigger the hassle. It also could be that the kid took the car without consent, in that case grandma can always say he took it without permission, then ya gotta get the money out of his parents, good luck.

Well, I have called the kid's insurance company 2 times and had to leave a message (what else). Of course, they have not returned the calls yet and I do not think they are going to. I will however keep calling until they do.

I don't know what the problem is. She should just call and tell me that they are going to rip me off because that's what it sounds like they are going to do.

They have to let you file a claim. Just call their claims number and say you want to file a claim. It seems unbelievable that they'd send you to voicemail if you did that.

Well, I will be getting a check from Safe Auto for the damage to my car. Turns out the kid's insurance was cancelled even though he had an insurance card.

After failed attempts to get return calls from Safe Auto, I went to my insurance agent and he somehow got through to them. When he called the girl at Safe Auto, he got her voice mail and when he started saying he wanted to talk to her supervisor, she picked up. So anyway, everything is square. Now I can get my car fixed.
