I hate my next door neighbors. They consist of an old couple and three of their children who just can't seem to leave the nest. The old couple can't speak much English (they are from Russia or something) and must be deaf as well judging from the loud jibberish coming from next door on a daily basis. The three children (I use the term "children" loosely as they're all past their mid twenties) come and go all day and night long, slamming car doors five or six times at a go. I mean, how many doors can one car have?

One afternoon, my husband caught the old woman sprinkling white powder all over plants of hers that happened to be right next to our fence. She also managed to get this white powder all over a newly planted sappling of ours. When she saw my husband coming, she took off. Well, a few days later, all the leaves on our new tree turned yellow, fell off and needless to say, the tree was dead. The crazy old bat's plants were dead too. When my husband tried to talk to her about it, she just ran off muttering "I no speak English". Yeah right! I think she killed our tree on purpose, so it wouldn't grow and ruin her view of our yard!

You or your husband will have to open up some line of communication with the old couple or their offspring if you want to get compensation for your tree.
Calmly explain the situation to them so they won't feel threatened or that you are trying to intimidate them, perhaps the neighbors or their adult children will offer to replace the tree - you wont know until you ask.
If they refuse, you can always try small claims court, but for the relatively small price of another tree they might just ignore the whole thing.
At the very least, they might not do it again if they think you are going to pursue the matter all the way to court.....

You could always get a bottle of weed killer and spray "ASSHOLE" across her lawn.

Maybe she was a gypsy and was putting a curse on you and your tree.

I would file a small lawsuit. Or plant THREE trees just far enough away from the fence that she can't get the white offender on your saplings.

LARGE PRIVACY FENCE - the tallest that local codes allow.
This way you don't have to see them - so much for having a tree do it...let'm try sprinkling gypsy powder on that to make it go away.
But I do like the weedkiller idea, they probably wouldn'y know what it meant.
