First question is: is the fence in violation of an agreement that you knew about? If it is, you'll likely lose.
If it's not in violation of any written agreement, you'll probably need to start with a carefully written letter to the association and follow that up as needed with a letter from an attorney.
If you're in the wrong though, you're going to end up losing so it may be better to work out a compromise rather than claim your 'rights' in defiance of a written rule.
What did you do and what did they claim you did?
pickets are uneven and there are screw sticking out and did not run it by them this is a very new development.
Would they have approved it if you had asked first and it was made nicely? Part of this is likely to just flex their muscles.
Maybe they'd leave you alone if you offered to fix it.
I have no prob.with fixing the fence the groun was uneven when i put up the fence (the rainy seasion)the letter was not clear as to what they mean, Isend them a letter back ask asking them to give me a betterl exam. as to what they want fixed. you cant see the fence from the road so I think it was the neighbor next door who i the one complaining about the fence. she dos not like me so much.
It may have been started by the neighbor. Now that the association is involved, you might be able to work this out. Apologize for not getting clearance first, and offer to fix the fence to meet the standards. Whether anyone can see it or not doesn't matter.
If you fix the fence so that it gets the approval of the association, that will piss off your neighbor completely!! It's an extra bonus.
If you jump up and down and insist that it's your right to put up poorly made fences, etc., the association will show you some document that says otherwise and make you tear it down. If you work with them to fix it, you'll get to keep the fence.
It seems like it sucks that the association can tell you what to do in your backyard, but imagine if your neighbor decided to paint the back of their house paisley. No one would see it from the street, but you would from your back yard and it would make it near impossible to sell your house if you wanted to. The rules which seem dumb to you now are there to protect both your and other's property values.
Cool, thanks so much for the info and I hope you are blessed with good neighbors.
No problem. Good luck with your negotiations. My neighbors are okay. A little noisy at times but they live pretty far away.
In your case, it's not like you tried to put up an electrified spite fence. A tasteful picket fence seems perfectly reasonable and I suspect the association will agree with you if you keep a level head.
